TERMS OF USE AND SALE

(Track / Racing Use Only Products)

1. Scope of Application

These Terms and Conditions govern all distance and online sales concluded with WORLD4TRACK via:

  • Website (www.world4track.com)

  • Social media platforms

  • Messaging applications

  • Email

  • Telephone

  • Contact forms

  • SMS

  • Online marketplaces (including but not limited to Subito.it)

  • Any other remote communication channel

By placing an order, the customer declares to have read, understood, and expressly accepted these Terms in full.

2. Nature and Intended Use of Products (CRITICAL CLAUSE)

TRACK / RACING USE ONLY

All products sold by WORLD4TRACK are:

  • Exclusively intended for track, racing, competition, or private testing use

  • NOT intended for road, street, or public highway use

  • NOT approved for road circulation

  • NOT homologated unless explicitly stated in writing

Legal Consequences

  • Any installation or use of the products on public roads is strictly prohibited.

  • The buyer assumes full and exclusive responsibility for:

    • Verifying legal compliance

    • Obtaining homologations or authorizations

    • Ensuring conformity with national or local laws

  • The seller assumes no liability whatsoever for:

    • Illegal use

    • Administrative fines

    • Vehicle seizure

    • Insurance invalidation

    • Civil or criminal consequences arising from road use

Use on public roads is entirely at the buyer’s sole risk and responsibility.

3. Technical Characteristics and OEM Disclaimer

Unless explicitly stated otherwise in writing:

  • Products are not OEM

  • Products are aftermarket and/or racing-grade

  • Products may:

    • Differ from original specifications

    • Affect vehicle behavior, emissions, noise, or safety systems

The buyer acknowledges and accepts these characteristics prior to purchase.

4. Prices and Taxes

  • All prices are expressed in Euro (€)

  • Shipping costs are excluded unless explicitly stated

5. Order Confirmation and Availability

  • Order submission does not constitute contract acceptance

  • Product availability and delivery times are verified after order submission

  • Confirmation is sent by email during business hours

The customer may:

  • Proceed with payment

  • Cancel the order without penalty prior to payment

Unpaid orders are automatically cancelled after 7 calendar days.

6. Shipping and Transfer of Risk

6.1 Transfer of Risk

Risk transfers to the buyer upon delivery of goods to the carrier, pursuant to applicable law.

6.2 Insured Shipping

  • Insured shipping must be explicitly requested at checkout

  • Without insurance, the seller bears no liability for loss, damage, or theft during transport

6.3 Damaged or Tampered Packages

  • The customer must refuse delivery or accept with written reservation

  • Immediate notification to the seller is required

  • Failure to comply waives any claim

Any replacement or compensation is entirely at the seller’s discretion.

7. Shipping Costs

Italy

  • €30.00

  • Surcharges may apply (remote areas, islands, oversized items)

International

  • Calculated and communicated after order placement

  • Free shipping thresholds may apply selectively

8. Quotes

  • Informal quotes: Free

  • Formal quotes (PDF, codes, measurements): €30.00 – €100.00 VAT included

  • Deductible from final order if placed within 7 days

9. Right of Withdrawal (EU Consumers)

9.1 Applicability

The right of withdrawal applies only to private consumers (natural persons acting outside business activity).

Businesses and VAT-registered professionals are excluded.

9.2 Conditions

Withdrawal must be:

  • Communicated within 14 days

  • Sent exclusively via:

    • Registered letter with return receipt, or

    • Certified Email (PEC)

Returned goods must be:

  • Unused

  • Uninstalled

  • Unopened

  • In original sealed packaging

9.3 Exclusions (Legally Enforceable)

The right of withdrawal is expressly excluded for:

  • Installed or tested products

  • Opened or unsealed packaging

  • Custom-made or personalized products

  • Products sourced or manufactured outside the EU upon request

9.4 Refunds

  • Refunds are issued within 14 days from receipt of goods

  • Shipping costs (outbound and return) are never refunded

  • Payment fees are deducted from refunds

10. Warranty and Conformity

Consumers benefit from a 2-year legal conformity warranty under EU and Italian law.

Warranty coverage:

  • Applies only to manufacturing defects

  • Requires inspection and supplier verification

  • Does not allow refunds

  • Allows replacement only with identical products

Damage due to:

  • Improper installation

  • Track misuse

  • Modifications

  • Overstress

  • Incompatible applications

Void the warranty immediately.

11. Pricing Errors

In case of pricing errors or catalog updates:

  • The customer will be contacted

  • The seller may cancel the order without liability

  • No contract is formed until confirmation

12. Product Images

Images are illustrative only and non-binding.

13. Limitation of Liability (IMPORTANT)

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by gross negligence

  • Mandatory consumer rights under EU law

All other liability is limited to the maximum extent permitted by law.
